1. Introduction
These Terms and Conditions govern your use of services provided by WESTVIEW SOLUTIONS LTD (Company Number: 17100330), a temporary employment agency registered in England and Wales.
By using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.
2. Definitions
- "Agency" refers to WESTVIEW SOLUTIONS LTD
- "Worker" refers to individuals seeking temporary employment through our agency
- "Client" refers to businesses or organizations hiring workers through our agency
- "Assignment" refers to a period of work undertaken by a Worker for a Client
- "We", "Us", "Our" refers to WESTVIEW SOLUTIONS LTD
3. Services Provided
We provide temporary employment agency services, specializing in the construction industry. Our services include:
- Sourcing and vetting construction workers for temporary assignments
- Matching qualified workers with suitable job opportunities
- Processing payroll and ensuring compliance with employment regulations
- Providing ongoing support throughout assignments
4. Terms for Workers
4.1 Registration
To register with our agency, Workers must:
- Provide accurate and complete information
- Hold valid qualifications and certifications (including CSCS card where applicable)
- Have the legal right to work in the UK
- Provide satisfactory references
- Possess appropriate Personal Protective Equipment (PPE)
4.2 Assignments
- Workers are not obligated to accept any assignment offered
- Once accepted, Workers must fulfill the assignment as agreed
- Workers must arrive on time and work professionally
- Workers must comply with Client site rules and health & safety requirements
- Workers must report any issues or incidents immediately to the Agency
4.3 Payment
- Workers will be paid according to the rate agreed for each assignment
- Timesheets must be submitted accurately and on time
- Payment will be made weekly/monthly (as agreed) via bank transfer
- Deductions will be made for tax, National Insurance, and any statutory requirements
4.4 Notice Period
Workers must provide reasonable notice if they need to terminate an assignment early. Failure to provide adequate notice may affect future assignment opportunities.
4.5 Conduct
Workers are expected to maintain professional conduct at all times. Misconduct, including but not limited to theft, violence, harassment, or intoxication, will result in immediate removal from assignment and termination of registration.
5. Terms for Clients
5.1 Engagement
When engaging our services, Clients agree to:
- Provide accurate job descriptions and requirements
- Ensure a safe working environment that complies with health & safety regulations
- Treat Workers with respect and professionalism
- Provide necessary induction and supervision
5.2 Fees
- Clients will be invoiced according to the agreed fee structure
- Payment terms are typically 14-30 days from invoice date
- Late payments may incur interest charges
- Fee structure covers worker wages, agency commission, and statutory costs
5.3 Timesheets
Clients must accurately record and authorize Worker timesheets promptly. Disputes regarding hours worked must be raised within 48 hours.
5.4 Direct Engagement
If a Client wishes to employ a Worker directly (permanent or fixed-term contract) during or within 12 weeks of an assignment ending, a transfer fee will apply as per our fee schedule.
5.5 Health & Safety
Clients are responsible for:
- Providing appropriate site induction
- Ensuring Workers have necessary PPE
- Maintaining safe working conditions
- Reporting any accidents or incidents immediately
6. Liability and Insurance
6.1 Agency Liability
We maintain appropriate Employer's Liability and Public Liability insurance. However, our liability is limited as follows:
- We are not liable for any loss or damage arising from Worker performance or conduct beyond our reasonable control
- We do not accept liability for injuries sustained on Client premises unless caused by our negligence
- Our total liability shall not exceed the fees paid by the Client for the relevant assignment
6.2 Client Liability
Clients are responsible for:
- Health and safety compliance on their premises
- Any injuries or incidents arising from unsafe working conditions
- Ensuring Workers are supervised appropriately
7. Data Protection
We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Please refer to our Privacy Policy for detailed information on how we handle personal data.
Both Workers and Clients consent to the processing of their data as necessary for the provision of employment agency services.
8. Termination
8.1 Termination by Agency
We reserve the right to terminate our relationship with Workers or Clients with immediate effect if:
- There is a breach of these Terms and Conditions
- Fraudulent activity or misrepresentation is discovered
- Payment obligations are not met
- Conduct is deemed unprofessional or unsafe
8.2 Termination by Worker/Client
Workers and Clients may terminate their relationship with us by providing written notice. Outstanding obligations must be fulfilled before termination takes effect.
9. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of WESTVIEW SOLUTIONS LTD and protected by copyright laws. Unauthorized use is prohibited.
10. Confidentiality
All parties agree to maintain confidentiality regarding:
- Commercial terms and fee structures
- Personal data and sensitive information
- Business operations and practices
This obligation continues after the termination of the business relationship.
11. Compliance with Regulations
We operate in compliance with:
- The Conduct of Employment Agencies and Employment Businesses Regulations 2003
- The Agency Workers Regulations 2010
- The Employment Rights Act 1996
- The Health and Safety at Work Act 1974
- UK GDPR and Data Protection Act 2018
- All other relevant UK employment legislation
12. Dispute Resolution
In the event of a dispute:
- The parties will first attempt to resolve the matter through good faith negotiation
- If negotiation fails, mediation may be pursued
- Legal action may be taken as a last resort
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the English courts.
13. Force Majeure
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, government actions, or technical failures.
14. Amendments
We reserve the right to amend these Terms and Conditions at any time. Changes will be posted on our website with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
